1.2 By accessing, browsing, or using any part of our Services, you agree to comply with and be bound by these Terms. If you do not agree to all of these Terms, you are not permitted to use the Services.

1.3 We reserve the right to revise these Terms at any time without notice. You are responsible for reviewing the most current version. Continued use of our Services indicates acceptance of any revised terms.


2. Legal Jurisdiction

2.1 These Terms are governed by the laws of England and Wales.
2.2 You irrevocably submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes.
2.3 Where permitted, we reserve the right to bring proceedings in your jurisdiction at our discretion.


3. Our Role

3.1 Emigoo acts as an agent or intermediary between users and third-party providers (“Suppliers”) of tours, events, experiences, or related services (“Products”).

3.2 Bookings are made directly with the Supplier via our platform. We do not operate or control the experiences listed.


4. Eligibility and User Obligations

4.1 By using our Services, you confirm that you are:

  • At least 18 years of age;
  • Legally capable of entering into a binding contract;
  • Using the Services only for lawful purposes.

4.2 You agree to provide accurate, current, and complete information and to maintain confidentiality of any login credentials associated with your account.

4.3 We reserve the right to restrict or terminate your access to the Services without notice for any breach of these Terms or other conduct deemed inappropriate by Emigoo.


5. Bookings and Payments

5.1 Bookings are only confirmed upon full payment unless otherwise agreed in writing.

5.2 All prices are listed in GBP (£), inclusive of VAT where applicable, and are subject to change without notice.

5.3 We reserve the right to:

  • Refuse any booking at our discretion;
  • Cancel or modify bookings due to errors, availability issues, or external factors.

5.4 Payments are processed via third-party payment processors. We are not responsible for errors or failures related to payment processing.


6. Cancellations and Refunds

6.1 All bookings are non-refundable, unless:

  • A Supplier explicitly offers a refund policy; or
  • Cancellation is required by UK consumer law.

6.2 We may offer, at our discretion, partial refunds or credit where reasonable.

6.3 No-shows and late arrivals are non-refundable, regardless of circumstances, unless the Supplier agrees otherwise.


7. Supplier Terms

7.1 Each Supplier may impose its own terms, conditions, waivers, or restrictions. You are solely responsible for reviewing and accepting them before completing a booking.

7.2 Emigoo disclaims all liability for the acts, omissions, or negligence of Suppliers, including any injury, delay, or loss incurred during the use of a Product.


8. Limitation of Liability

To the maximum extent permitted by law:

8.1 Emigoo shall not be liable for:

  • Any indirect, incidental, or consequential loss;
  • Any personal injury, property damage, or death;
  • Any act or omission by a third-party Supplier or external provider;
  • Any travel disruptions, cancellations, strikes, force majeure, or governmental restrictions.

8.2 Our total liability to you in respect of any booking shall not exceed the amount paid by you for that booking.

8.3 Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.


9. User Content and Conduct

9.1 You may submit content such as reviews, photos, or suggestions (“User Content”).

9.2 By submitting User Content, you:

  • Grant us a perpetual, royalty-free licence to use, reproduce, and distribute the content;
  • Confirm you own or have permission to share it;
  • Acknowledge we may moderate or remove content at our discretion.

9.3 You must not:

  • Post false, defamatory, or unlawful content;
  • Infringe the rights of others;
  • Use our platform to harass, abuse, or spam others.

10. Intellectual Property

10.1 All website content, design, logos, and software are the property of Emigoo or its licensors.

10.2 You may not copy, reproduce, or exploit any part of the Services without prior written consent.


11. Force Majeure

We are not liable for delays or failure to perform any obligations due to events beyond our control, including but not limited to:

  • Natural disasters
  • Pandemics
  • War, terrorism, or civil unrest
  • Internet or utility outages
  • Governmental restrictions or legal changes

12. Data Protection and Privacy

12.1 We collect and process personal data in accordance with the UK GDPR and the Data Protection Act 2018.

13. Termination

13.1 We reserve the right to suspend or terminate your use of the Services at any time for breach of these Terms or any legal requirement.

13.2 Upon termination, all rights granted to you under these Terms cease immediately.


14. General Terms

14.1 These Terms represent the entire agreement between you and Emigoo Tour Int Ltd.

14.2 If any provision of these Terms is found to be invalid, the remaining provisions will remain in full force and effect.

14.3 Any delay or failure to enforce these Terms will not constitute a waiver.

14.4 These Terms do not create any agency, partnership, or employment relationship.
