1. PREAMBLE AND PARTIES

These Terms and Conditions (“Terms”) constitute a legally binding agreement between:

The User/Customer: Any individual or entity visiting, browsing, or making a booking through the website (hereinafter referred to as “You”, “Your”, “Traveller”, or “Customer”).

The Company: EMIGOO TOURS INT LTD, a company registered in England and Wales under Company Number 15818442, with its registered office at 125 Valence Avenue, Dagenham, England, RM8 1TR (hereinafter referred to as “We”, “Us”, “Our”, or “Emigoo”).

By accessing emigoo.com (the “Site”) and/or making a booking, You acknowledge that You have read, understood, and agree to be bound strictly by these Terms. If You do not agree to these Terms, You must immediately cease using the Site.

2. SCOPE OF SERVICES & AGENCY

2.1 Role of the Company: Emigoo acts primarily as a booking agent for third-party tour operators, guides, and transport providers (“Service Providers”). While we curate and list these services, the contract for the service itself is often between You and the Service Provider.

2.2 Service Descriptions: We strive to ensure that all tour descriptions and prices are accurate. However, We accept no liability for errors or omissions in the descriptions provided by third-party Service Providers.

3. BOOKING AND PAYMENTS

3.1 Booking Process: A booking is not confirmed until You receive a Booking Confirmation email from Us.

3.2 Payments: All payments are processed securely via Stripe. By making a booking, You authorise Us (and our payment processor) to charge the full amount to Your selected payment method.

3.3 Pricing: Prices are subject to change without notice until the booking is confirmed. We reserve the right to correct pricing errors. If a booking is made at a clearly incorrect price, We reserve the right to cancel the booking and refund You in full.

4. CANCELLATION AND REFUND POLICY

Strict Adherence: You explicitly agree that all refunds and cancellations are governed by the terms below and our detailed Refund Policy available at: https://emigoo.com/refund-policy/.

4.1 Cancellation by the Customer

  • Notification: You may request a cancellation, provided such requests are made a minimum of 7 days before the scheduled tour date.
  • Fees: Valid cancellation requests are subject to a strict administrative and cancellation fee ranging from 5% to 30% of the total booking value, depending on the specific tour operator’s terms. This fee will be deducted from any refund.
  • Non-Refundable Items: Unless explicitly marked as “Free Cancellation” on the specific tour page, entrance tickets, reservation fees, and skip-the-line passes are strictly non-refundable.
  • Process: To request a cancellation, You must contact us via email. Approvals are at Our sole discretion.

4.2 Cancellation by the Company (Emigoo)

  • Right to Cancel: We reserve the absolute right to cancel any booking at any time—up to one (1) minute prior to the scheduled departure—due to Force Majeure, safety concerns, extreme weather, strikes, insufficient participation, or unforeseen operational issues.
  • Remedy: In the event of a cancellation by Us, Your sole remedy is a 100% full refund of the amount paid to Us.
  • Exclusion of Consequential Loss: We are not liable for any additional expenses incurred by You as a result of Our cancellation, including but not limited to international flights, accommodation, travel insurance, visas, or vaccinations.
  • Refund Timeline: Refunds for company-initiated cancellations are prioritized. The standard processing time is 5–7 business days, though this may vary depending on banking institutions.

4.3 No-Show and Lateness

  • Strict Policy: If You fail to arrive at the designated meeting point at the scheduled time (“No-Show”), no refund will be applied.
  • Lateness: Guides are strictly instructed not to wait for late arrivals to avoid disrupting other guests. Lateness constitutes a No-Show.

5. CHANGES AND AMENDMENTS

5.1 Date Changes: Requests to change the date of a booking are subject to availability and are not guaranteed. If We cannot accommodate a date change request, the standard Cancellation Policy applies.

5.2 Itinerary Changes: Service Providers reserve the right to alter itineraries, routes, or transportation due to maintenance, weather, or local conditions. Such changes do not entitle You to a refund unless the core service is materially and fundamentally altered.

6. TRAVEL DOCUMENTS AND INSURANCE

6.1 Documents: It is Your sole responsibility to ensure You have valid passports, visas, and health documents required for the tour location. We are not liable if You are refused entry to a country or a specific site due to lack of documentation.

6.2 Insurance: We strongly recommend that You purchase comprehensive travel insurance that covers cancellation, medical expenses, and repatriation. Emigoo does not provide travel insurance.

7. TRAVELLER CONDUCT AND INDEMNIFICATION

7.1 Code of Conduct: You must strictly follow the instructions of the tour guide.

7.2 Illegal Activity: If You engage in any illegal activity, theft, vandalism, violence, or offensive behavior, Your tour will be terminated immediately without refund.

7.3 Indemnification: You agree to indemnify, defend, and hold harmless Emigoo Tours Int Ltd, its directors, employees, and agents from and against all claims, losses, liabilities, expenses, damages, and costs (including legal fees) resulting from:

* Your violation of these Terms;

* Your violation of any third-party right; or

* Any illegal or negligent act committed by You during a tour.

8. INTELLECTUAL PROPERTY

8.1 Ownership: All content on emigoo.com, including text, graphics, logos, images, and software, is the property of Emigoo Tours Int Ltd or its content suppliers and is protected by UK and international copyright laws.

8.2 Restrictions: You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service or the Site without express written permission from Us.

9. LIMITATION OF LIABILITY

PLEASE READ CAREFULLY:

9.1 General Exclusion: To the fullest extent permitted by applicable UK law, Emigoo Tours Int Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

9.2 Cap on Liability: In no event shall Our total liability to You for all claims arising out of or relating to the use of the Service exceed the amount You paid to Us for the specific booking giving rise to the claim.

9.3 Force Majeure: We are not liable for any failure or delay in performance where such failure is due to causes beyond Our reasonable control (Acts of God, war, terrorism, pandemics, government restrictions, etc.).

10. GOVERNING LAW AND JURISDICTION

10.1 Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of England and Wales.

10.2 Dispute Resolution: You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or its subject matter or formation.

11. GENERAL PROVISIONS

11.1 Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in full force and effect.

11.2 Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11.3 Modifications: We reserve the right to modify or replace these Terms at any time. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms.
